Craig Sephton QC persuades High Court to strike out defamation claim against Andrew Tinkler

Craig Sephton QC of Deans Court Chambers represented Andrew Tinkler, CEO of the Stobart Group, in an action for libel and slander brought against him by a disgruntled former employee, Peter Elliott. Mr Elliott told the High Court that he expected to win very substantial damages from Mr Tinkler in his claim. However, the judge struck Mr Elliott’s claim out as an abuse of the process of the court. He said that Mr Elliott had brought and conducted the claim not so as to vindicate a right but rather in a manner designed to cause the defendant problems of expense, harassment, commercial prejudice or the like beyond those ordinarily encountered in the course of properly conducted litigation.
